Privacy policy

How personal data provided by users in connection with their use of the kominkowychill.pl website is processed and protected.

1. This Privacy Policy sets out how personal data provided by users in connection with their use of the services offered by the kominkowychill.pl website (hereinafter: the Website) is processed and protected.

2. The controller of the personal data held on the Website is Andrzej Ustupski, ul. Miłośników Podhala 135, 34-425 Biały Dunajec, Poland (hereinafter: the Controller).

3. To keep the personal data entrusted to it secure, the Controller follows internal procedures and guidelines that comply with the relevant data protection legislation, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR).

4. The Controller takes particular care to protect the interests of the data subjects and, in particular, ensures that personal data is:

   • processed lawfully;
   • collected for specified, lawful purposes and not further processed in a manner incompatible with those purposes;
   • accurate and adequate in relation to the purposes for which it is processed;
   • kept in a form which permits identification of the data subjects for no longer than is necessary to achieve the purpose of the processing.

5. Personal data is processed on the basis of consent given by users of the Website, and in cases where applicable law authorises the Controller to process personal data.

6. The Controller processes the personal data voluntarily provided by users of the Website solely for the purpose of:

   • answering enquiries sent by users through the contact form,
   • accepting bookings made through the online booking system,
   • providing the services rendered by the Controller, on the basis of Article 6(1)(b) GDPR,
   • marketing, including sending commercial information to an email address, where the client has consented to this by ticking the relevant box while making a booking or submitting an enquiry through the contact form. Consent to the processing of data for marketing purposes and to receiving commercial information may be withdrawn by clicking the relevant link in the message received, or by sending such a request to the Controller's email address,
   • pursuing the legitimate interests of the data controller in specific cases, on the basis of Article 6(1)(f) GDPR, for example debt recovery or video monitoring of the premises.

7. Recipients of the personal data may be authorities, institutions and entities entitled to it under the law, as well as entities providing services to the data Controller (for example legal, IT, marketing and accounting services, and other entities involved in delivering the service ordered).

8. The Controller may use automated decision-making, including profiling, for marketing purposes and to tailor its offer.

9. Users of the Website who have provided data processed by the Controller have the right to access that data. Users also have the right to rectify their data, to request its erasure, and to restrict or object to the processing of their personal data at any time. Users may also request the erasure of their personal data from the Website at any time. The right to data portability does not apply, because no standard has been established for exchanging such data between hotel properties.

10. Users of the Website have the right to withdraw their consent at any time, without affecting the lawfulness of processing carried out on the basis of that consent before its withdrawal.

11. To exercise the rights set out in point 9 above, users of the Website should contact the Controller using the same email address or telephone number they provided to the Website, writing to kominkowy.chill@gmail.com

12. Every user of the Website has the right to lodge a complaint with the Polish data protection authority (Urząd Ochrony Danych Osobowych).

13. The Controller obtains information about users and their behaviour in the following ways:

    • through information entered voluntarily in forms,
    • by collecting cookie files.

14. On their first visit to kominkowychill.pl, users are informed about the use of cookies. By remaining on the site, the user accepts the use of cookies on the website. If the user does not change their browser settings, this is treated as consent to the use of cookies.

15. Installing cookies is necessary for the proper provision of services on the Website. Cookies contain the information needed for the website to work correctly, in particular for those parts that require authorisation. Users may change their browser settings for handling and storing cookies at any time.

16. The following types of cookies are used on the Website:

    • session cookies, which remain in the browser until it is closed or until the user logs out of the website on which they were placed,
    • persistent cookies, which remain in the device's browser until the user deletes them or until a predetermined time specified in the cookie's parameters.

17. By function, cookies can be divided into:

    • conversion cookies, which make it possible to analyse the performance of different sales channels,
    • tracking cookies, which together with conversion cookies help analyse the performance of different sales channels,
    • marketing cookies, used to personalise advertising content and target it correctly,
    • analytics tools, which help improve the experience of using the site by showing how visitors use it,
    • essential cookies, which are fundamental to the basic functionality of the site. The cookies we use allow us to develop our website.

18. Some cookies may be placed by the provider of the website and the online booking system solely in order to:

    • improve and support the booking process,
    • analyse and collect statistical data on the use of the website and the online booking system, in order to improve them.

19. Bookings are made in the online booking system of an external provider, Roomadmin (roomadmin.pl), which is embedded in the pages of the Website in a frame (iframe). The Website does not run a booking system of its own: the booking form, the availability calendar and the booking confirmation all operate on that provider's side, under that provider's own terms and privacy policy.

20. The data users enter in the booking form, that is the data needed to make a booking, such as name, contact details, dates of stay and number of guests, is sent to the system of the provider named above and processed in order to accept and perform the booking. The basis for this processing is the performance of a contract, that is Article 6(1)(b) GDPR. Providing this data is voluntary, but a booking cannot be concluded without it.

21. The frame containing the booking system does not load automatically when a page is opened. It starts only after the user deliberately clicks a booking button or an availability button. Until then, no content belonging to the provider runs in the user's browser and none of the provider's cookies are stored.

22. If the user chooses to pay online, the payment is handled by the payment operator indicated in the booking system. The user enters their payment card details directly with that operator. Neither the Website nor the Controller collects, processes or stores payment card details.

23. The Website may contain links to other websites, which operate independently of the Website and are in no way supervised by it. Those sites may have their own privacy policies and terms and conditions, which we recommend reading carefully.

24. The Controller reserves the right to change the Website's privacy policy, which may be prompted by developments in internet technology, possible changes to data protection law, and the development of the Website. We will inform users of any changes in a visible and understandable way.
